The Supreme Court had to change its 2 major decisions in the last one month. The special thing is that both these cases were heard by the bench of Supreme Court Judge Justice Jamshed Burjor Pardiwala. After this, Chief Justice BR Gavai had to interfere. Stray dogs and judges of Allahabad High Court were handed over to a three -judge bench in the case removing criminal cases. At the same time, a case related to Himachal Pradesh has been removed from Pardiwala and handed over to three judges led by Justice Vikram Nath.
First case
August 4: Decision to remove judge from hearing of criminal cases
In the Supreme Court, a bench of Justice JB Pardiwala and Justice R Mahadevan issued an order to remove Justice Prashant Kumar of Allahabad High Court on August 4 from hearing of criminal cases. Justice Prashant Kumar justified criminal summons in a civil dispute.
Justice Pardiwala considered it a mistake and said- Prashant Kumar should not be given the responsibility of the criminal case till retirement. Such orders make fun of the judicial system. We do not understand what is happening in the Indian judiciary at the High Court level.
August 8: Pardiwala removed the comment After the intervention of CJI BR Gawai, a bench of Justice JB Pardiwala removed the comment in which he criticized the Allahabad High Court Judge Prashant Kumar. It was clarified that he did not intend to embarrass or discredit Prashant Kumar.
Second case
August 11: Send stray dogs to shelter home
A 2-judge bench headed by the Supreme Court Justice JB Pardiwala ordered all stray dogs to be removed from the residential areas of Delhi-NCR in 8 weeks and sent to the shelter home. The verdict was pronounced in view of matters of dog bytes and rabies.
This decision was opposed across the country. After this, on August 13, CJI BR Gawai assured to reconsider the ban on stray dogs from Delhi-NCR roads. The case was handed over to a three -judge bench headed by Justice Vikram Nath.
August 22: Sterilization of stray dogs and leave
The Supreme Court withdrew the decision to send stray dogs to shelter homes on August 11 to Justice JB Pardiwala. Said that the dogs who are caught, should be left back from where they are sterilized and vaccinated. However, dogs with rabies -infected and aggressive behavior should be kept in the shelter home.
Third case
July 28: Himachal will disappear from the map due to environmental imbalance
The bench of Justice Pardiwala and Justice R. Mahadevan expressed concern over the environmental imbalance in Himachal Pradesh. Said that if the situation does not improve, the entire state can disappear in the air. The bench said that earning revenue is not everything. Revenue cannot be earned at the cost of environment and ecology. He said that if the situation remains like this, then the day is not far when Himachal Pradesh disappears from the map of the country.
Currently, the matter has been removed from Justice Pardiwala and handed over to a three -judge bench headed by Justice Vikram Nath.
