The Delhi High Court while hearing a rape case said that in such cases the accused should be infamous, not the rape Victim. Society should change its thinking.
The court made this comment on Friday while hearing the petition of the accused. The accused had argued that, if you are canceled on me, then this will give relief to the victim from social stigma and infamy.
However, the court dismissed the argument and imposed a fine of Rs 10,000 on the accused. Justice Girish Kathpalia was hearing the case.
Court order, 2 main things
- The slander should not be the victim, but the crime. Society should change thinking. Shame should come to the boy or man who raped, not the girl who had to face such a huge problem.
- This argument is absolutely wrong, because the injustice happened to the girl, not with her parents. Only that girl (victim) could forgive the culprit, that too under certain circumstances. As mentioned above, the victim is still a minor.
What is the whole matter
The case is in the year 2024. The accused made a video of the minor, then made a physical relationship by blackmailing him. In the FIR, a case of rape was registered against the accused under Section 6 of POCSO Act and section 65 (1) and 137 of the Code of India Code (BNS).
