The Supreme Court on Tuesday said that if there is a clear ban in any recruitment rules, then those candidates of the reserved category who have joined the open competition of General category after taking exemption in fees or age, cannot be considered for selection of unreserved seats later.
A bench of Justices Suryakant and Justice Joymalya Bagchi canceled the Tripura High Court order in this regard. The court said that deciding it will depend on the facts of every case whether the candidates of the reserved category who have joined the open category are eligible for selection in unreserved seats.
The matter was related to the appeal of the Central Government in which the order of the Tripura High Court was challenged. The High Court had directed the petitioners to consider for selection in the unreserved category, who applied for the post of Constable (General Duty) after taking age relaxation in the OBC category.
