The Supreme Court on Wednesday said that there is a tradition of Kanyadaan in Hindu society, under which when a woman marries, her gotra (clan or lineage) also changes. In such a situation, the property of a widow and childless Hindu woman without will be given to her husband’s family, not her maternal uncle.

In fact, a petition was being heard in the Supreme Court, in which Section 15 (1) (B) of the Hindu Succession Act, 1956 is challenged. Under this Act, if a widow and childless Hindu woman dies without a will, her in -laws get her property.

Justice BV, the only female judge of the Supreme Court, Nagratna said during the hearing of the petition- there is a structure of Hindu society and you cannot drop it. We do not want our decision to break something that has been going on for thousands of years.
