270 people died in the plane crash on July 9 in Ahmedabad.

It is not right to blame the pilot without knowing anything. The pilot’s family, the family of the victim and everyone else have the right to know what happened in the plane crash and why. In many cases, hardware or software malfunction is also responsible. Boeing and other manufacturers are very powerful in the US. He is a powerful lobby, PR and powerful speaker. I think Boeing will use all these to protect their products and will ensure that his product is safe.

This is to say of American lawyer Mike Andrews, who will fight a case against the Boeing Company on behalf of the families of 65 victims of Ahmedabad plane crash. In this case, Andrews, who reached Gujarat, has given an exclusive interview to Divya Bhaskar, in which he has raised many questions on the Boeing company and said that everyone is watching what is happening in India at this time.

Question: How many families have joined legal action? Are British citizens also involved in this? answer: We currently have 65 aggrieved families with us. These include the passenger of the plane and the families of those killed on the ground. They are citizens of both Britain and India. He has approached our law firm.

Question: What legal options do families have? answer: Those options will be decided after finding out the causes of plane accidents. For example, if there is a malfunction in the Boeing aircraft, a case will be registered against Boeing in the US. Maybe there is a problem with sub-component manufactures or software developers. It all depends on what is the problem. If it is only the fault of Air India or the pilot, the matter will be according to the Montreal Convention. It will be recorded in Britain or India.

Question: What was the real reason for the Ahmedabad plane accident? Pilot’s mistake, technical fault or anything? answer: Right now we are thinking with an open mind. We do not know. We feel that it is too early to take any decision now.

Question: Why do you consider Boeing responsible only? Why not Air India? answer: We do not want to guess beforehand. We say that all the information should be revealed. The full flight data recorder and voice recorder should be revealed. We just want to check the evidence without reaching any guess or conclusion. For this, the data of flight data recorder and voice recorder is very important.

Question: On which legal grounds will you hold Boeing or other companies responsible? What will be the legal basis? answer: It depends on what caused the accident. For example, engine controller software. If the problem is in the thrust control malfunction monomodation system, we will decide on the basis of it. Thrst control malfunction is a software package, which is designed to prevent the engine from walking at a high speed.

Question: When Boeing knows that another case is going to be registered against him, what will happen? answer: Any such incident is negative for any construction company. Therefore, whatever is happening in India at this time, the whole world is eyeing it.

Question: Do you think Boeing will use its strength to suppress the truth? answer: Boeing and other manufacturers are very powerful in the US. He has a powerful lobby. He has a powerful PR. He has a powerful speaker. I think Boeing will use all these to protect his product. They will ensure that their product is safe.

Question: Why does the Western media always hurry to convict the pilot without any evidence? answer: We are constantly listening to this story. Pilot’s mistake is convicted in many plane accidents. The pilot can make any kind of mistake and lead to an accident. In such cases, it is easy to respond immediately and blame the pilot, as he cannot defend himself. If we find evidence like flight data recorder and cockpit voice recorder, we can reach the conclusion of what happened at the time of the accident.

Question: Why is non-western or Indian pilots blamed every time? The same happened in the 2018 Lion Air accident. answer: Pilots outside the US are blamed, which is wrong. Although there was no American citizen in the Ahmedabad accident, this matter is still important for us. Because everyone’s life is important, whether he is an American citizen, a British citizen or an Indian citizen.

Although the complete information has not been revealed, it is too early to guess and blame the pilot immediately. We know that the Government of India and Air India have access to the cockpit voice recorder and flight data recorder. The information present in that data is important and decisive. When this information is available with experts and lawyers, the whole picture will be clear.

Question: Do you think paid news is being run in favor of Boeing? answer: PR efforts for Boeing continue. We have seen many times that for many manufacturers, when there is a negative event, failure or any problem, many good news starts coming in its favorite. But our focus is on evidence.

Question: Which flaws in Boeing aircraft have already been proved in other accident cases? answer: There were many flaws. First of all, 737 Max aircraft comes to my mind, because it has just happened. In addition, there was a recent incident related to an uncommended software input. In this incident, the aircraft had a problem. The pilot that was ordering, was actually reversing it. That is, it was clearly a technical problem. That is why we want to know what the evidence of the Ahmedabad accident says. Because it is possible that the uncommended input coming from flight controls should be responsible for the accident.

Question: Is any of these incidents related to 787 Dreamliner? answer: Ha, Boeing 787 has similar incidents before. In our opinion, at least 2 incidents associated with Boeing 787 aircraft were extremely suspicious in the last 2-3 weeks. In 2019, when the Boeing 787 aircraft of Penne Airways was landing, the flight control software felt that the aircraft is on the ground and the software turned on the thrust control malfunction system (TCMA).

TCMA is a system that can control the power of the engine itself. The same system cut the power of the engine. Whereas, the aircraft was not flying at this time. Rather it was landing on the ground. So it reached the end of the runway rapidly.

Apart from this, electricity went away from Dallas Airport to Munich on July 25 after flying in an engine of 787 flight. The pilot released the ‘Made’ call. After this, the emergency landing of the plane had to be done.

Question: Boeing is a very big company. If you emphasize its software, why does the company not improve its software? answer: This is a great question. Often the software contains bugs, disturbances occur, many times the problem is not known until it is in the field. The company uses software because it is tested properly. Accidents are rare. There are many reasons behind the release of poor software and poor systems. I always believe that any system should be tested before making public use.

Question: Have you received a flight recorder and cockpit voice recorder data, which you requested earlier? answer: Yes, flight data recorders and cockpit voice recorders can be obtained through court order. Sometimes this data is not released until a case is registered against the company.

Question: Did you ask for data from them before fighting the case? answer: Yes, I always ask, but they never give data themselves, until the case is registered.

Question: Why is it necessary to include American and British legal arrangements in this case? answer: It is very important to implement American laws. The manufacturer company that has created and sold defective equipment or defective products is responsible for the entire company. In such a situation, if there is a malfunction in the aircraft, Boeing and other companies (no matter what they are) will have to come to America and face the matter.

Question: Which American court are you considering fileing a case? Generally, there is an option of Federal Court and Home State Primary Defense. In this case, if Boeing shifted to his Hetquorter Illinoy, the case will probably be filed in the Federal Court of Virginia.

Question: How long does it take to get justice in such international aviation cases? answer: I think AAIB will take about a year to prepare a detailed report with other investigating agencies. Only then will we be able to make it clear whether a claim should be filed against the Boeing or equipment company.

Question: Have you gone to the accident site? answer: Yes, we went there and stayed for a long time. We also interacted with some people and families of the victims present there. Going to the accident site gives you a chance to feel what exactly happened at that time. We watch pictures and videos, but we do not understand the whole thing well until we go to the scene.

Question: Have you met personally from Indian and British families of victims in Gujarat? answer: Families from India and Britain have contacted us. All the families who contact us want answers. Those families want to know what happened? Why did this happen? They have come to us so that they can get complete information. Those families want transparency from Air India and the government.

We want the cockpit voice recorder and flight data recorders to be made public. If not for the public, at least for those lawyers who are working on this matter. Because in that data, there is sensitive information about what was really happened at the time of the accident.

Every family affected is pleading for help. Trying to understand what happened? The victim’s family wants to know who is responsible for this tragedy? This should not happen to anyone else. What can be done for this?

Question: Western media is now raising fingers on Air India and pilots? answer: Yes, Boeing and many Western media are now raising finger on Air India and pilots. We have heard the discussion about the switch. But only a few information has been revealed from the cockpit voice recorder, in which the other pilot is saying that I did not stop the switch. So until we get to know what exactly happened.

Question: What lessons have been received from the accidents of Lion Crash and Ethiopian 302, which can be implemented to prevent future disasters? answer: Such incidents give this lesson that transparency is very important. It is important to know what happened, why it happened. Only after such information is revealed, one can be held responsible. It is important to know everything from the beginning.

Question: Why doesn’t anyone learn from accidents? answer: There are many reasons for this. Accidents occur frequently. This is also a truth. The equipment may deteriorate. Sometimes testing can also cause problems. Usually focus is on making things economical in business. Sometimes companies reduce costs in which it should not be actually cut. In such cases, security may be compromised.
