The Supreme Court on Thursday heard the team-Badal case of 10 MLAs of the Bharat Rashtra Samithi (BRS). The court ordered the Speaker of the Telangana Legislative Assembly to take a decision on petitions to disqualify these MLAs under the tenth schedule of the Constitution in 3 months.
The bench of Chief Justice BR Gavai and Vinod Chauhan of Justice said, “We cannot allow the situation where the operation is successful, but the patient dies.”
The Supreme Court also dismissed the order given by the Division Bench of the Telangana High Court on 22 November, in which the instructions of the single judge’s speaker were canceled to determine the time of the proceedings.

After the 2023 state assembly elections, 10 BRS MLAs joined the Congress party. One of these MLAs even contested the 2024 Lok Sabha elections on a Congress ticket.
In the same case, the Supreme Court gave an important verdict on the petitions filed demanding disqualification of these MLAs under the anti-party law (tenth schedule).
In the 2023 assembly elections, the Congress defeated BRS. The Congress got 64 out of 119 seats, while BRS, which had won 88 seats last time, was reduced to just 39 seats. BJP and AIMIM got eight and seven seats respectively.
BRS first reaches Supreme Court in High Court The BRS appealed to the High Court after 10 MLAs changed his frost. Speaker Ji Prasad Kumar was accused of not taking any action. The speaker had said in response that the High Court did not have the right to order the matter.
Those demanding disqualification argued that the ruling party and MLAs would get time to break the petitions, which is fatal to democracy.
BRS leader Katie Rama Rao and Padi Kaushik Reddy reached the Supreme Court. In a petition, the Telangana High Court’s order for disqualification of three MLAs has been challenged by the November 2024, while another petition was filed with the remaining 7 MLAs.
