The Punjab and Haryana High Court while hearing a case on Monday said that trying to start an unwanted thing with a woman is not a crime. Even if the attempt to negotiate makes the woman disturb or not like it.

Justice Kirti Singh’s court was hearing a petition filed against the FIR in an incident of tampering with a medical student at Rohtak PGI. The court said that it in itself is not a crime like breach of identity under Section 354 of the Indian Penal Code (IPC). The court then rejected the case.

Know, what is the whole matter…
- Both were students in Rohtak PGI: According to defense lawyer Advocate Aman Pal, the case is of 2019. At that time, the complainant was a student at Rohtak PGI, both the complainant. One day the woman complained to the police that she was molested by the young man.
- In the library, the young man tried to talk to the woman: The woman had told the police that she was sitting in the library. Meanwhile, the accused youth came and sat near him. He said in English- Hey, I want to talk to you (listen, I want to talk to you) and tried to talk. He did this several times.
- The woman did not talk: According to the complaint, the young man had told the woman that she is the anesthesia resident. He saw the girl on Scooty. After this he came to the library to talk. Whereas, the woman kept telling her again and again- I don’t want to talk to you (I don’t want to talk to you).
- The young man went without harmony: The defense counsel says that the woman has told in the FIR that after this the accused youth left from there. The woman has also admitted in the statement that the accused neither committed any force nor attacked her. After this, the woman lodged an FIR for molestation.
In the case, the court said these 2 things …
- The accused did not use physical force: Justice Kirti’s court, while giving a verdict in the case, said that the accused neither used any physical force nor tampering. Just trying to start a conversation is not a crime that dissolves the decency of the woman.
- Running such a case is misused by law: The court said- In this case, the necessary elements of Section 354 of the IPC are not completed here. In such a situation, running a case will be misused.
During the hearing, Advocate Aman Pal on behalf of the petitioner, Brijesh Sharma (AAG, Haryana) from the state and Advocate Amit Rao from the victim appeared in the court.
