CJI BR Gavai was speaking at Sir Moris Ralt Memorial Lecture 2025 held at Mauritius on Friday.
Chief Justice (CJI) BR Gawai said on Friday that the Indian judicial system runs from Rule of Law (rule of law), it does not have a place of bulldozer action. CJI was speaking at the Sir Moris Ralt Memorial Lecture 2025 held at Mauritius.
He said that in a recent judgment, the Supreme Court had clarified that running a bulldozer against an accused was to break the process of law. CJI said-

The government cannot become a judge, jury and executioner simultaneously. Bulldozer regime is a violation of Article 21 (right to protect life and personal freedom) of the Constitution.
Mauritius President Dharambir Gokhul, Prime Minister Naveen Chandra Ramgulam and Chief Justice Rehana Mangli Gulbul were also present during the lecture.

Ended unjust laws like triple talaq
CJI also mentioned decisions such as ending triple talaq, cancellation of adultery law, electoral bond scheme and privacy as fundamental rights. Gawai said that all these decisions showed that the court has made the Rule of Law a concrete principle, ending arbitrary and unjust laws.
Rule of Law Ethical and Social Infrastructure in India
CJI Gawai said that the rule of law in India is not only a set of rules, but it is a moral and social structure, which ensures equality, dignity and good governance. He cited the contribution of Mahatma Gandhi and Dr. Bhimrao Ambedkar, saying that his attitude shows that the rule of law in democracy leads the society to justice and accountability.
September 24- Satisfactory order against bulldozer action
Earlier, CJI Gawai said on 24 September that he was extremely satisfied on ordering bulldozers action. The human aspect was also involved in this decision. Can not disturb a family just because a member of that family is a criminal. Gawai said,

What did the Supreme Court order in November 2024…
The Supreme Court ruled on bulldozer action in November 2024. The court had said that officers cannot become judges. They should not decide who is the guilty. The bench had also said that if the construction dropped without a 15 -day notice, it would have to be rebuilt at the expense of the officer. The court also gave 15 guidelines.
