The Odisha High Court said that if there is no evidence of wife’s income, then it is wrong to assume that all educated wives want to live on husband’s money. It is also wrong to call them women who do not work, ie ‘useless class’.

The court admitted that the husband could not prove that the wife had permanent income. He did not give any documents or evidence to know how many cases the wife is advocating and earning.

Given all these arguments and facts, the High Court refused to intervene in the Family Court order. And said that ‘now the husband will have to pay Rs 10,000 every month for both wife and daughter.’

In fact, a person challenged the order of the Family Court, in which he was instructed to give the lawyer wife and the adult daughter to give a alimony of Rs 10,000 every month.

Two main comments of the court …

  • Being educated does not prove that the woman is not intentionally working or wants to be a burden on her husband. It is wrong to keep such thinking until there is no concrete evidence.
  • When there is no objection to the husband’s second marriage, there is a legal basis for the wife to stay apart. The husband himself has applied for divorce, so he cannot get any benefit from the argument left by his wife.

The husband said in the petition that his wife is educated and earns more than that. She also alleged that the wife had left home on her own will, so she is not entitled to maintenance.

In this case, the wife said that she is definitely a lawyer, but her earnings are very low. At the same time, they have to bear the education and other expenses of the daughter studying law. The wife alleged that the husband had married a second.
