Justice Biwi Nagratna has expressed displeasure over government institutions. They have said that they are fighting cases in which there is no possibility of victory. Due to this, the resources of the country are being wasted and the precious time of the courts is also deteriorating.
The Supreme Court judge joined the National Arbitration Conference in Bhubaneswar on 27-28 September at 2025. The theme of the session was to strengthen the eco-system of mediation in India. Justice Nagaratna’s speech appeared on Tuesday.
During this, he said, if government institutions continue to commit such cases again and again, both the money and judicial time of the country will continue to be spent in the wrong direction. Follow the path of better arbitration than this.

Justice Nagratna asked the lawyers to consider themselves “to solve human struggles” and adopt the path of mediation. He said, arbitration is not a weak way of justice, but a new way, easy and equal justice. Arbitration is not just to get a decision, but also to reach justice.
Suggestion: Green Mediator, become a patient Advocacy Group
Justice Nagratna suggested that ‘Green Mediator’ for environmental disputes, ‘patient Advoche Group’ for health affairs, WAI for intellectual property rights and arbitration clause should be included in the startup agreement.
As the chairperson of the Juvenile Justice Committee, he said that there should be arbitration between the victims and the accused in the cases of minors. It should be operated by trauma mediators.

Justice Nagratna said that if the government departments will continue to appeal repeatedly in every case, even if there is no possibility of victory, it will ruin both time and resources and the precious time of the courts will also be bad. He emphasized that the government dispute resolution system needs “major improvement”.
He said that if the officials look at the arbitration decision between a government body and the contractor with suspicion, the entire system of mediation between the state and private institutions will weaken.
