The monsoon session of Parliament starts from July 21.
Leader of Opposition in Lok Sabha and Congress MP Rahul Gandhi has demanded state status to Jammu and Kashmir. Rahul wrote a letter to PM Modi and said that in the upcoming monsoon session of Parliament, a bill should be brought to give Jammu and Kashmir full state status.
Rahul also mentioned Prime Minister Modi’s old statements in his letter. When the PM spoke of providing state status to Jammu and Kashmir at Bhubaneswar on 19 May 2024 and Srinagar on 19 September 2024.
Apart from this, Rahul also requested the government to bring Ladakh to bring laws to include Ladakh in the sixth schedule of the Constitution.
In the year 2019, two union territories were created while removing Article 370 and 35A. At that time, the government assured to restore the status of full state when the state’s situation was normal.
State status legal process to Jammu and Kashmir … 2 points
- Under the Jammu and Kashmir Reorganization Act, 2019, the state of Jammu and Kashmir was reinstated in two union territories. Therefore, for the status of the full state, a law will have to be changed in Parliament and change the restructuring act. These changes will be under sections 3 and 4 of the Constitution.
- To give state status, approval of new legal changes in the Lok Sabha and Rajya Sabha will be necessary, that is, this proposal is necessary to get approval from Parliament. After approval it will be sent to the President. After his approval, the day the President will issue a notification of this legal change, Jammu and Kashmir will get full state status.
What will change in Jammu and Kashmir after the status of the full state?
- The responsibility of police and law and order will come to the state government. The government will have direct control over the police.
- The state government will also get the right to enact laws on cases related to land, revenue and police.
- The Governor will not interfere in running the government then.
- The dependence on the center for financial assistance will end. Financial assistance will be given from the Finance Commission.
- The state assembly will get the rights to enact laws in public order i.e. public order and concurrent list matters.
- If the government offers a financial bill, then it will not need to take the approval of the Governor for this.
- The state government will have complete control over the Anti Corruption Bureau and All India Services. That is, the transfer and posting of the officials in the state will be according to the state government, there will be no control of the Lieutenant Governor.
- Changes in Article 286, 287, 288 and 304 will get all the rights to the state government in cases of trade, tax and commerce.
- 10% of the ministers of the number of MLAs in the Union Territory can be made, this bond of ministers will also be eliminated by the restoration of state status and up to 15% of the number of MLAs will be made ministers.
- Apart from this, the state government will get more rights from the Center in the release of the prisoners of the jail and fulfilling the rest of the election promises of the National Conference.
The first assembly election occurred in the state after Article 370 was removed

Assembly elections were held for the first time in October 2024 after Article 370 was removed. The result of the three -phase election came on 8 October. The National Conference (NC) emerged as the largest party. The party got 42 seats. NC’s ally Congress won 6 and CPI (M) won one seat.
The BJP became the second largest party with 29 seats. At the same time, PDP, the largest party in the 2014 assembly elections, got only 3 seats. Iltija Mufti, daughter of party chief Mehbooba Mufti, also lost to Bijbehra seat. The party won 28 seats in the last election.
