The Supreme Court said on Tuesday- it is common for neighbors to quarrel. If there is a quarrel, debate and scuffle between the neighbors, it cannot be considered a crime under the abetment of suicide (Section 306 of the IPC).
A bench of Justice Biwi Nagaratna and KV Vishwanathan canceled the Karnataka High Court’s decision in which a woman was sentenced to three years for neighbor’s suicide.
The court said, “A case of abetment of suicide under Section 306 is made only when it is clear that the accused deliberately forced the victim to commit suicide.”

The Supreme Court said that there was a sharp debate between the accused and the families of the victim in this case. But it cannot be assumed that the accused forced the victim to commit suicide.
The bench said, such quarrels happen in everyday life. On the basis of facts, we cannot assume that the accused instigated so much that the victim has no option but to commit suicide.

The case is from Karnataka in 2008. A woman and her neighbor (the victim) continued to fight for six months and there was an argument. The victim (teacher in private school) alleged that the neighboring woman constantly harasses her, which she was living under mental stress. He committed suicide by allegedly fed up with this stress.
After the incident, the accused was booked under IPC Section 306 (Ukasana for suicide). The Karnataka High Court sentenced the accused to three years, though acquitted him by the SC/ST Act. Now the Supreme Court has canceled the sentence.
