The Supreme Court on Tuesday heard the petition for the appointment of former High Court judges in the tribunal. The court questioned the role of the Center during the hearing. He said that retired judges appointed in the tribunal have to beg the facilities like housing and car. The NGT Bar Association Western Zone has filed a petition for the appointment of the High Court in the tribunal. During the hearing, the Supreme Court admitted that the reason for not taking interest in the roles after retirement by the judges is lack of facilities. The court said that if the government is unable to improve this situation then it should be abolished.

Supreme Court Justice BV Nagratna and R.K. Mahadevan said that this deficiency is due to the central government. He created a tribunal but did not give enough budgets or resources to run them. He further added that if the center could not provide facilities, then finish all the tribunal and send all the matters to the High Court.
The court said-

Why do they apply and attend the interview and then why not take over? One reason is that they face reality, how it is to become a tribunal member. Some of them, if they are president, are former Chief Justice of the High Court or former judge of the Supreme Court. They are not provided any facility.
Judges have to beg
The bench told Additional Solicitor General Vikramjit Banerjee- Parliament has passed the Act. Judicial influence was not taken. No expenses are paid. They have to beg for stationery, housing, car. The most dilapidated car of your department is given to the Tribunal President. How are you treating former Chief Justice and Judges?
Banerjee said- will send messages to the center The Additional Solicitor General informed the apex court that two former judges were offered to appoint, but they did not take over and the appointment process would have to start afresh, which would take time.
The Supreme Court also rejected the petitioner’s demand that the current members be allowed to continue after retirement till the appointment of new members. The next hearing of the case will now be held on 16 December.
